A BILL to repeal section eight-a, article five-b, chapter sixteen
of the code of West Virginia, one thousand nine hundred
thirty-one, as amended, relating to substituted consent for
health care services in extended care facilities operated in
connection with hospitals.
Be it enacted by the Legislature of West Virginia:
ARTICLE 5B. HOSPITALS AND SIMILAR INSTITUTIONS.
§1. Repeal of section relating to substituted consent for
health
care services in extended care facilities operated
in connection with hospitals.
Section eight-a, article five-b, chapter sixteen of the code
of West Virginia, one thousand nine hundred thirty-one, as
amended, is hereby repealed.
NOTE: The purpose of this bill is to repeal a section of
the Code rendered obsolete with the enactment of the Health Care
Surrogate Act (Article 30B, Chapter 16, Acts of the Legislature 1993). Extended care facilities operated in connection with
hospitals are included within the definition of a health care
facility (§16-30B-3 (h)) under the provisions of the Health Care
Surrogate Act.
